1. Overview of Responsibilities
RETAILS.co.za provides a platform for independent vendors to sell their products and services to customers. While we facilitate these transactions, certain responsibilities fall to vendors and customers, which are detailed below.
1.1 RETAILS.co.za Responsibilities
- Platform Provision: We provide and maintain the marketplace platform, including the website, tools, and services that enable vendors to list products and services, and customers to make purchases.
- Vendor Vetting: We may verify vendors to ensure they meet certain standards before allowing them to sell on our platform. However, we do not endorse or guarantee the quality, safety, or legality of any products or services listed.
- Payment Processing: We provide secure payment processing systems to facilitate transactions between customers and vendors.
- Customer Support (Platform-Related): We provide support related to platform usage, account management, and basic transaction facilitation.
1.2 Vendor Responsibilities
Vendors on RETAILS.co.za are independent sellers, and they are responsible for:
- Product Listings: Vendors are responsible for creating accurate, clear, and honest product descriptions, prices, and images.
- Order Fulfilment: Vendors must process and fulfil customer orders in a timely manner and according to the terms agreed upon at the time of the sale.
- Shipping and Delivery: Vendors are solely responsible for shipping and delivering their products to customers. Vendors must set their shipping policies, costs, and timelines, and ensure orders reach customers within the communicated timeframe.
- Returns and Refunds: Vendors are responsible for handling customer returns, exchanges, and refunds based on their own policies, which must be clearly communicated in their product listings.
- Compliance with Laws: Vendors must comply with all applicable laws and regulations, including consumer protection laws, and ensure that their products and services are legally sold in the regions they target.
1.3 Customer Responsibilities
- Providing Accurate Information: Customers must provide accurate and complete information for billing, shipping, and account creation.
- Reading Listings Carefully: Before making a purchase, customers are responsible for reading product descriptions, terms, and shipping details provided by vendors.
- Direct Communication with Vendors: For issues such as shipping delays, order inquiries, or product-related concerns, customers should communicate directly with the vendor. RETAILS.co.za may assist in resolving disputes but is not responsible for the resolution of individual order issues.
2. Account Creation and Management
- Eligibility: To register and use RETAILS.co.za as a vendor or customer, you must be at least 18 years of age and provide accurate, complete registration information.
- Account Security: You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.
3. Payment Terms
- Vendor Earnings: Vendors receive payments for sales made on the platform, subject to any applicable fees (e.g., subscription fees, commissions).
- Fees and Commissions: Vendors pay a subscription fee of R250 per month and a 7% commission on each sale. Additional fees may apply for paid promotions or featured listings. All transaction fees are ex. VAT.
- Customer Payments: Customers must pay for orders at the time of purchase through our secure payment gateway. All transactions are processed in South African Rand (ZAR).
4. Order Fulfilment and Delivery
- Vendor Responsibility: Vendors are solely responsible for the processing, shipping, and delivery of their products. Any issues related to shipping delays, missing items, or damaged products must be handled directly by the vendor.
- Delivery Timeframes: Vendors are required to communicate estimated delivery times to customers. RETAILS.co.za is not responsible for delivery delays or failures caused by vendors or shipping carriers.
5. Returns and Refunds
- Vendor-Specific Policies: Each vendor sets their own return and refund policies. Customers should review these policies before making a purchase.
- Dispute Resolution: While RETAILS.co.za provides the platform for transactions, any disputes related to product quality, returns, or refunds must be resolved between the customer and vendor. RETAILS.co.za may mediate but does not assume responsibility for resolving these disputes.
6. Prohibited Activities
The following activities are strictly prohibited on RETAILS.co.za:
- Listing illegal, counterfeit, or prohibited items.
- Providing false or misleading information in listings.
- Engaging in fraudulent activities or attempting to defraud customers or vendors.
- Using the platform for any unlawful or unethical purpose.
7. Limitation of Liability
- RETAILS.co.za is a Platform Provider: RETAILS.co.za is not the seller of any products or services listed on the platform. We act solely as an intermediary between vendors and customers. We are not liable for any direct or indirect damages arising from transactions between vendors and customers, including issues with product quality, shipping, or fulfilment.
- Vendor Accountability: Vendors are solely responsible for their product listings, shipping, returns, and any claims or disputes with customers. RETAILS.co.za does not assume responsibility for any loss, damage, or disputes resulting from vendor actions.
8. Intellectual Property
All content on RETAILS.co.za, including but not limited to text, images, logos, and designs, is the intellectual property of RETAILS.co.za or our vendors and partners. You may not use, reproduce, or distribute this content without permission.
9. Termination of Accounts
RETAILS.co.za reserves the right to suspend or terminate accounts at our discretion if users or vendors violate these Terms & Conditions or engage in prohibited activities.
10. Amendments
We reserve the right to update these Terms & Conditions at any time. Changes will be posted on our website, and continued use of the platform indicates acceptance of the new terms.
